Know all Men by these presents that I Thomas McCloskey of Frederick Town, Frederick County and province of Maryland Brickmaker am held and firmly bound unto James Smith of the same Town County and province Merchant in the just and full sum of fifty pounds current money, to be paid unto the said James Smith his certain attorney Executors, administrators or assigns, to the which payment well and truly to be made and done I bind myself my Heirs Executors and administrators firmly by these presents sealed with my seal and dated this 4th day of June 1774.
The condition, of the above obligation is such that if the above bound Thomas McCloskey or his heirs do and shall well and truly make over and convey unto the above named, James Smith his heirs or assigns, within one month from the day of the date hereof by a good sure perfect and inde-feasible [sic] Estate of Inheritance in fee simple three certain lotts or portions of ground lying and being in the Town, County and province afs [aforesaid]: and whereon the aforesaid Thomas McCloskey now lives and keeps a Brick Yard that then the above obligation to be void and of none Effect otherwise to stand be and remain in full force power and virtue in Law.
